12.5 YAKMATE makes no representations or warranties:

(a) that any material is virus free. You should take your own precautions in this respect to protect
or prevent any damage to your system. YAKMATE accepts no responsibility for any malicious
  code that may be introduced into your system by using any part of the YAKMATE Website
    including the Forums & Blog.
(b) in relation to any of the material on the YAKMATE Website, Forums or Blog (including any warranties     as to the quality, accuracy, completeness or fitness for any particular purpose of such material);

12.7 You will indemnify YAKMATE if we suffer any loss or damage or incur any costs in connection
with your

(b) breach of any other legal obligation by you or

(d) conduct on the Video or in the Forums or Blog Comments (Posts) Submitted.

This is an Essential step in the YAKMATE YOUR YAK Page Video Submission Form & Process. Only Videos that YAKMATE Members have First Uploaded to YouTube will be able to have their URL's Submitted to YAKMATE to be viewed. Do not attempt to Submit a URL of a Video that has not first been Uploaded to YouTube. 1.9 The Video Content can be removed from YAKMATE by Using the UPDATE Button on the YOUR YAK Page, then selecting the Close Option on the UPDATE Page or simply by deleting it from YouTube. The Written Material / Comments associated with the Video, upon this Closure process. will Automatically be Archived in the CLOSED TOPICS FORUM where Comments can still to be Viewed but not Added to. 1.10 YAKMATE May Without Notice amend or add to the Terms of Use Conditions without notice, and it is your responsibility to review these Terms of Service for any changes. Your use of the YAKMATE Website following any amendment or addition of these Terms of Use will signify your assent to and acceptance of its additions or revised terms. It is a Condition of Ongoing Use by You that you Accept any Additional or Amended Conditions. 1.11 YAKMATE reserves the right to discontinue any aspect of the YAKMATE Website at any time. 1.12 These Terms will be governed by and construed in accordance with the laws of the state of New South Wales, Australia.

	2. MEMBERSHIP ACCOUNTS 2.1 You Must Be 18 Years or Older to become a Member of YAKMATE. If you are Younger than 18 years of Age & have an Issue or a Point of View that you wish to Highlight on YAKMATE then YAKMATE allows you to have your legal guardian (18 years of age or older) to Join & Submit the Video or Comments on your behalf. In doing this then the Person who Joins & Submits the Material to YAKMATE is Solely Responsible for the Content & any Loss or Legal Matters that may arise from it. 2.2 In order to access some features of the YAKMATE Website, you will have to create a YAKMATE account. When creating your account, you must provide accurate and complete information to YAKMATE. The Submission & Ongoing Use of Ficticious Personal Details is not permitted. A Complete & Valid Name & Contact details are required for YAKMATE Membership. Multiple Membership User ID's are not permitted. Only One Membership is permitted for any Individual & any email address provided. 2.3 When choosing a Username please ensure that it is socially acceptable. Usernames that may be perceived as funny by some may offend others. Please be mindful of this as your membership will be cancelled and any content that you may have submitted prior to cancellation will also be removed. 2.4 You are solely responsible for the activity that occurs on your account, & you must keep your account Username, Password, YM Number & Secret Question Answer secure. You must notify YAKMATE immediately of any breach of security or unauthorized use of your YAKMATE Membership account. Contact the YAKMATE Administrator on admin@yakmate.com.au with a Subject Title of : SECURITY. 2.5 You may never use another YAKMATE Members account without the expressed permission (as for example would be required in Condition 2.1) of that YAKMATE Member. 2.6 YAKMATE May at it's sole discretion, at any time & without any Prior Notice, Terminate your Membership for what it deems is a blatant (or otherwise) violation of any of the YAKMATE Terms of Use Conditions. 2.7 If you wish to Cancel your Membership then please email the Administrator on: admin@yakmate.com.au

	3. YAKMATE'S RIGHTS 3.1 YAKMATE reserves the right at its sole discretion to : (a) remove any material on the YAKMATE Forums or Blog at any time. (b) remove Access to any Video that YAKMATE deems contravenes the Terms & Conditions of Use. (c) terminate your Membership & / or Access to the Forums if YAKMATE believes you have breached the Terms of Use. 3.2 YAKMATE will not pass email addresses, messages or any other contact information between members. Please do not request this from YAKMATE. Members can OPENLY Communicate with each other openly via the FORUM POSTS or PRIVATELY via the YAKMATE COMMENT FORUMS Email System available to all Members using the Private Messaging Facility of the FORUMS User Control Panel. 3.3 YAKMATE may be required to Provide Membership details as & if required to by law if there has been any form of illegal activity or infringement. YAKMATE will observe this under Law and will provide this information to Law Enforcement Agencies as required. (PLEASE BE MINDFUL OF YOUR CONTENT !).

	OWNERSHIP & COPYRIGHT 4.1 All Material Submitted by you needs to be your Own & be Lawful in both Manner & Content. This Appies to both the Video & Comment Material Submitted by You & as detailed in the ' Forum & Blog Rules ' & the ' Video ' Sections of these Terms of Use. 4.2 Other than the YAKMATE Member Submitted Material, Copyright on all other Material on the Website Pages, Forums or Blog is owned or licensed by YAKMATE. You may not in any form or by any means modify, reproduce, store, distribute, print, display, perform or publish any of this content on the website without YAKMATE'S prior written permission. 4.3 YAKMATE takes the issue of Copyright Infringement seriously and it is not permitted on the YAKMATE Website in any form whatsoever. FREE SPEECH vs DEFAMATION 5.1 While YAKMATE Encourages Members in the use of FREE SPEECH Careful Consideration by All Users at all times needs to given to the Content of Any Material that you submit or make a comment on so as not to harm anyone in anyway or contravene laws dealing with Defamation. 5.2 Deliberate Defamatory or Malicious comments are neither welcome or permitted for use in any form on the YAKMATE Forums or Blog or indeed in any VIDEO that can be accessed by the URL submitted to YAKMATE.

YOUR ACCEPTANCE & OBLIGATIONS 6.1 You must be 18 Years of Age to Accept the Terms of Use Conditions & Obligations contained within. 6.2 In Submitting your Membership on the Login Page or a Video URL on the Your Yak Page Forms to YAKMATE you are Accepting & Agree to abide by ALL the YAKMATE Conditions in the Terms of Use as outlined in this document. 6.3 In your use of the Website, you will otherwise comply with the terms and conditions of the YAKMATE Terms of Service, and all applicable laws and regulations. 6.4 Any Indirect or attempted violations of the YAKMATE Terms of Use Conditions including the Forums & Blog Rules and actual or attempted violations by a third party on your behalf shall be considered a violation of the User Agreement by you.

Material associated with possible violations to Copyright, Defamation, Pornography or that is in any way Offensive or Obscene in nature will not be tolerated & will be removed as soon as Practicable after it is reported & reviewed by YAKMATE administration. 7.3 Should you object to any of the Terms of Use Conditions or any subsequent amendments then your only option is to discontinue the use of the YAKMATE Website its Forums & Blog immediately. 7.4 You will be Courteous & Respectful to all other YAKMATE Members & of their Issue / Point of View regardless of whether you believe it to be of a trivial nature or not. What may not be of concern to you & your lifestyle may in fact be an impost on & important to another YAKMATE member. 7.5 You will be Honest, Truthful & Factual with all content you provided to YAKMATE & refrain from providing any Content that contains false, misleading or deceptive information or misinformation or rumour. In using any element of YAKMATE you have an Obligation to your fellow Members (Yaksters) to be Precise, Concise & Factual in all that you submit so as they can provide their support on your issue. 7.6 Elected Representatives Names are Submitted to YAKMATE by you only as a request for that person to assist you. Naming them does not assign any BLAME in anyway to that Elected Representative. YAKMATE encourages Elected Representatives to use the site & respond to Comments Posted. 7.7 Name calling, racist, abusive, obscene, threatening, sexist, sexual, pornographic, defamatory, indecent, religiously bigoted or any other offensive content posted (including inappropriate usernames) that may offend, vilify, insult or humiliate any person on the basis of race, religion, ethnicity, gender, age, sexual orientation or any physical or mental disability is NOT WELCOME at YAKMATE & should never be used. Swearing or any form of profanity or comments that are spiteful in nature will not be tolerated under any circumstances. (PLEASE BE MINDFUL OF YOUR CONTENT !) 7.8 You will not provide to YAKMATE a Video URL or Post any material on the Forums or Blog that : (a) is unlawful or prohibited or makes reference to illigal activities. (b) impersonates or infers you are any other person or enitity (c) is not your own original material in which you own exclusive copyright; (d) may infringe on the the intellectual property rights of any other third party; (e) advertises or promotes any goods or services, other websites, competitions or any other matter. This includes any Contact Information. Members must not use the forums to solicit custom / business of any kind without the written permission from YAKMATE. (f) malicious code, viruses or any other form of files or programs designed to interrupt or destroy the functionality of any other computer software or hardware. (g) contains personal information of third parties including but not limited to, their name, phone numbers, mail, email address or any other personal information. (h) harrasses or is deliberatley antagonistic in nature. (i) contains a third party URL or Domain Name. 7.10 A Character Limit of 1000 Characters is permitted for each Comment Post. Exceeding this limit by making successive Posts is not allowed and may result in your Post being permanently removed. 7.11 Spamming or any deliberate misuse of the YAKMATE Forums & Blogs is not permitted & will not be tolerated. Any such Misuse will result in your YAKMATE Membership being terminated.

SECURITY & PRIVACY 8.1 You will not Attempt to gain Access to Unauthorised Areas of the YAKMATE Website, Forum or Blog. 8.2 The Website uses SSL (Secure Socket Layer) Encryption Facilities for Pages where you are required to enter Person Details. This is a Safety Measure to ensure your details are kept as secure as possible once submitted to YAKMATE. These Pages are identified by a Padlock Symbol in the Locked Position being shown on your page (Top or Bottom Banner depending on your Operating System) and by the URL having https instead of the regular http in the URL Address. 8.3 YAKMATE will NEVER Send You an Unsolicited Email Requesting you to Provide any Personal Information. If you receive such a Request Disregard this & forward the Email to the YAKMATE Administrator on admin@yakmate.com.au with a Subject Title of : SECURITY. 8.4 All Details submitted by YAKMATE Members will never be passed to third parties unless required to be by Law. EMAILS & CORRESPONDENCE 9.1 The YAKMATE Email Adresses provided on the CONTACT US Page are to be used to assist YAKMATE Members attain the Information & Assistance they require, so You agree to not knowingly transmit material that contains Viruses or Malware that may impact on the YAKMATE Email addresses. 9.2 You will not engage in spamming or any other hostile activity in relation to the YAKMATE Email Accounts. 9.3 Email that YAKMATE deems to be abusive or offensive in any way will not be responded to & if you are a YAKMATE Member will provide cause for your Membership being terminated without notice. 9.4 All correspondence including administration issues between YAKMATE and its members are to be considered private and confidential. They are therfore not to be posted or discussed in the YAKMATE Forums or Blogs. This includes the content of emails, letters and telephone conversations or any other form of communication mode. Any Unauthorised Publication of such may result in you being held legally responsible for any ensuing loss or damage suffered by YAKMATE or another party.

VIDEOS 10.1 YAKMATE reserves the right to decide whether Content or a User Submission is appropriate and that it complies with the Terms of Service for violations other than copyright infringement, such as, but not limited to, pornography, obscene or defamatory material. Such Material will have the URL deleted from the database & the Associated Membership Terminated Immediately. 10.2 Any Video material that you do not know the origins or the ownership of and / or you do not have permission to use from the lawful owner, should not have the YouTube URL submitted to YAKMATE. YAKMATE does not encourage or permit such use. If you choose to do so then you do so at your own risk. 10.3 Any Video material that you view that you believe is a copyright infringment should be reported to the YAKMATE administration admin@yakmate.com.au immediately with a Subject Title of : COPYRIGHT. 10.4 You are Freely Submitting your Video to Share with the Wider Community in good faith & in consideration of all related Terms of Use Conditions (1 to 12) as outlined above & below.

COMMERCIAL USE 11.1 You will NOT Use YAKMATE for any COMMERCIAL PURPOSES without the Written Authority from YAKMATE ADMINISTRATION. 11.2 Videos or Comment Posts Submitted that contain direct or indirect Advertsing, Sponsorship or Business Contact information is NOT PERMITTED. Any Advertising Enquiries on the YAKMATE Website Pages should be Directed to sales@yakmate.com.au. 11.3 As a Member, You agree not to solicit, for commercial purposes, any users of the Website with respect to their User Submissions in the Forums or Blog.
